CRIMINAL DEFENSE

Drunk Driving-DUI/DWI

DWI-Driving while impaired means that either the driver's blood alcohol concentration (BAC) is .08 or more, or that there is evidence that shows that the driver's normal coordination has been substantially impaired due to the consumption of alcohol. The maximum penalties are 1 year and $1000 for the first offense, 2 years and $2000 for the second offense, and 3 years and $3000 for the third offense. In addition, 12 points are marked against the driver's license and the driver's license may be revoked at an MVA hearing.

DUI-Driving under the influence means that either the driver's BAC is between .4 and .07 or more, but less than .08., or that there is evidence that shows that the driver's normal coordination was impaired to some extent due to the consumption of alcohol.  The maximum penalty is 60 days and $500 for a first offense and 1 year and $500 for a subsequent offense. In addition, 8 points are marked against the driver's license and the driver's license may be suspended at an MVA hearing.

 

Traffic Tickets

Including but not limited to speeding, failure to stop at a red light, reckless driving, failure to stop for a school bus, improper turn, failure to yield, driving without a license,driving alone with a permit, driving without proof of insurance.   

 

Assault

Assault means the crime of assault, battery, or assault and battery.

Assault in the 1st degree means causing or attempting to cause serious physical injury to another and the offense carries a maximum penalty of 25 years in prison.

Assault in the 2nd degree means intentionally causing physical injury to another person and it carries a penalty of 10 years, or a $2,500 fine, or both.

Reckless Endangerment means engaging in conduct that creates a substantial risk of death or physical injury to another and it includes discharging a firearm from motor vehicle. It carries a maximum penalty of 5 years, or $5,000 fine, or both. 

 

Theft

Obtaining or exerting unauthorized control over property using deception, or possessing stolen property if the person intends to deprive the owner from its property.

If the property is valued between $1000 and $10,000, the penalty is 10 years in prison or $10,000 or both , and the the property or its value must be restored to its owner.

If the property is valued between $10,000 and $100,000, the penalty is 15 years in prison or $15,000, or both, and the property or its value must be restored to its owner.

If the property is valued $100,000 or more, the penalty is 25 years in prison or $25,000, or both, and the property or its value must be restored to its owner.
